Terms and Conditions (T&C)

1. Scope

These Terms and Conditions (T&C) govern the use of all services provided by MW MEDIA LLC (“Provider”) through its digital platform for the automated creation of AI-generated job advertisements. These terms apply to all users, including companies and agencies (e.g., recruiting agencies).

2. Service Description

MW MEDIA LLC offers a cloud-based software solution for generating and managing visual and text-based job advertisements using AI technology. The features and limitations of the service depend on the chosen subscription plan.

3. Contract Conclusion

A binding contract is concluded when a user registers on the platform and selects a paid subscription plan. The user will receive a confirmation email immediately after completion of the sign-up process.

4. Prices & Payment Terms

  • All prices are in EUR and exclude applicable VAT.
  • Billing is done monthly or annually in advance.
  • Accepted payment methods include credit card, SEPA direct debit, and other options as made available by the Provider.
  • Plan changes (e.g., from monthly to yearly) are possible at the end of the current billing cycle.

5. Term & Termination

  • Contracts are concluded for either a monthly or annual term depending on the selected plan.
  • Cancellation is possible at any time at the end of the billing period.
  • Cancellations can be made through the user account or in writing.
  • Access remains active until the end of the paid period.

6. License & Usage Rights

MW MEDIA LLC grants the user a non-exclusive, non-transferable right to use the platform and the generated content for internal business purposes.

Resale, sublicensing, or redistribution of the platform or generated content is prohibited without written permission from the Provider. Agencies may use the platform on behalf of their clients only under the appropriate agency license model.

7. User Responsibilities

  • Users must keep their login credentials secure and confidential.
  • The platform must be used in compliance with all applicable laws and regulations.
  • MW MEDIA LLC reserves the right to suspend or terminate accounts in the case of misuse or breach of terms.

8. Liability

  • The Provider is only liable for damages caused intentionally or through gross negligence.
  • Liability for indirect damages, loss of profits, or consequential damages is excluded.
  • Users are solely responsible for verifying the legal compliance and correctness of AI-generated content before publishing or using it. MW MEDIA LLC accepts no liability for the content created.

9. Data Protection

MW MEDIA LLC processes personal data in accordance with applicable data protection laws (especially the GDPR). Details can be found in the separate Privacy Policy.

10. Right of Withdrawal

As the services provided by MW MEDIA LLC are digital products that are made available immediately after purchase and are tailored to the user’s configuration, there is no right of withdrawal once the service has started.

By accepting these Terms and Conditions and starting to use the service, the user explicitly agrees to the immediate provision of the digital content and waives any right of withdrawal in accordance with applicable consumer protection laws.

11. Changes to Terms

MW MEDIA LLC reserves the right to modify these Terms and Conditions at any time with future effect. Users will be notified in advance of any changes. If the user does not object within 14 days of notification, the updated terms shall be deemed accepted.

12. Final Provisions

  • These Terms shall be governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
  • Jurisdiction for all disputes shall be the registered office of MW MEDIA LLC, provided the user is a business.
  • Should any provision of these Terms be or become invalid, the remaining provisions shall remain unaffected.
